Washington, D.C. — Former U.S. President Donald Trump has strongly criticized a federal appeals court decision that struck down several tariffs imposed during his administration, warning that removing them would “completely destroy” the country and “instantly obliterate” its military power. In a post shared on Truth Social on Sunday, Trump lashed out at what he called a “Radical Left group of judges” who issued the 7-4 ruling, though he praised one Democratic judge — an Obama appointee — for voting in his favor. “Without Tariffs, and all of the TRILLIONS OF DOLLARS we have already taken in, our Country would be completely destroyed, and our military power would be instantly obliterated,” Trump wrote. “In a 7 to 4 Opinion, a Radical Left group of judges didn't care, but one Democrat, Obama appointed, actually voted to save our Country. I would like to thank him for his Courage! He loves and respects the U.S.A.” The remarks come just days after the U.S. Court of Appeals for the Federal Circuit ruled that Trump overstepped his authority when he imposed import tariffs using emergency powers. The court found that the International Emergency Economic Powers Act (IEEPA) does not grant the president the authority to enact tariffs in the manner Trump did. In an unsigned opinion, the court upheld an earlier ruling that Trump's use of the IEEPA represented an "unprecedented overreach" of executive power. The decision emphasized that under the U.S. Constitution, the power to impose taxes and tariffs lies with Congress, not the president. Trump had already responded to the decision on Friday, calling the court “highly partisan” and claiming that the tariffs would remain in place regardless of the ruling. “ALL TARIFFS ARE STILL IN EFFECT! Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end,” Trump wrote on Truth Social. “If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong.” Although the court found the tariffs unlawful, it has delayed the enforcement of its decision until October.
